UPDATE 2-Obama administration overturns ban on some iPad, iPhones

WASHINGTON Aug 3 (Reuters) - The Obama administration has overturned a U.S. trade panel's ban on the sale of some older iPhones and iPads, reversing a ruling that had favored Samsung Electronics Co Ltd over Apple Inc in their long-running patent battles.

The U.S. International Trade Commission in June banned the import or sale of the iPhone 4, iPhone 3GS, iPad 3G and iPad 2 3G distributed by AT&T Inc, saying the devices infringed a patent owned by the South Korean electronics giant.

U.S. Trade Representative Michael Froman on Saturday vetoed the ban, saying his decision was in part based on its "effect on competitive conditions in the U.S. economy and the effect on U.S. consumers." He said Samsung could continue to pursue its case through the courts.

Samsung said it was "disappointed" at the lifting of the ban. "The ITC's decision correctly recognized that Samsung has been negotiating in good faith and that Apple remains unwilling to take a license," it said in a statement.

Apple welcomed the news and applauded the administration "for standing up for innovation." It added, "Samsung was wrong to abuse the patent system in this way."

The Apple products targeted by the ITC ban are more than a year old, though some models such as the iPhone 4 remain solid sellers. Apple sells more than 100 million iPhones annually, but it does not break down sales by models.

Apple and Samsung have been waging a global patent war since 2010, filing multiple lawsuits against each other over the design and functionality of their devices.

This ITC ban is specific to a Samsung patent on technology that allows devices to transmit multiple services simultaneously and correctly through 3G wireless technology.

Such patents are called "standard essential patents" and they cover technology that must be used to comply with standards set by industry organizations.

The Obama administration has been pressing for most infringements of standard essential patents to be punished by monetary fines instead of sales injunctions.

Froman on Saturday said the ITC should thoroughly examine the public interest ramifications of its rulings in disputes over standard essential patents.

Designed to be a trade panel, the ITC has become a popular venue for patent lawsuits because it acts relatively quickly and can order import bans, which are more difficult to get from district courts.

While the ITC was created to ensure that U.S. companies can compete fairly against imports, a number of foreign companies with U.S. manufacturing plants have filed patent complaints with the agency. Samsung has a plant in Austin, Texas.

ITC cases can be appealed to the U.S. Court of Appeals for the Federal Circuit, and from there to the Supreme Court.

Apple has a parallel complaint filed against Samsung at the ITC, accusing the South Korean company of copying the iPhone and iPad. An ITC judge in that case found that Samsung had violated one patent but not a second one. A final decision is due in August.

Samsung makes phones that run on Google Inc's Android operating software, the market leader. Apple has also sued other Android phone makers including HTC Corp for patent infringement.

The case at the International Trade Commission was No. 337-794.

The Dye-Hard Colorist Behind Gaga, Ferreira, And M.I.A.'s 'Dos

"I was definitely a punk-rock, skater, Riot Grrrl, low-maintenance tomboy," says colorist Aura Friedman from her perch at that refined temple for high-maintenance manes, Sally Hershberger Downtown in New York. In fact, the woman who's brought an extra dose of hard-edged pixie dust to the hair of dyed fashion darlings like M.I.A., Lady Gaga, Jennifer Lawrence, and Sky Ferreira never thought she'd be in the biz at all. "When I moved to Northern Virginia in summer ?92," she tells us between appointments, "there was nothing for me to [do], so I ended up getting a job at a hair salon...but really wanted a job at the pet store." Fortunately for us, Friedman's future did not involve hamsters and exotic snakes (at least not directly), but rather she was fated to change how we all look at hair color.

A Riot Grrrl in the world of high-gloss celebrity styling, she's found a way to make shocking pinks elegant, gray treatments youthful, ombre unexpected, and artificial colors beautifully organic. It's no mean feat to lead a revolution that's putting greens, blues, and bright reds in places where no Manic Panic has been before. Though, as we found out in a quick chat, upturning color conventions came fairly naturally to Friedman (after a ton of hard work, of course). Read on.


Introduction to Color Theory
"When I started, I was shampooing, sweeping, doing the laundry ? stuff like that ? but it turned out to be a really rewarding job. People would ask for me, divulge their deepest, darkest secrets, and I knew, by working their hair, I was making them feel good (that's what I liked the most). Now, I chose color (as opposed to cutting), because I took tons of art classes all of my life, and the one thing my teacher would always say was ?great color scheme!? That always suck with me.?

Self-Promotion
?When I first started working at Bumble and bumble, I went to the PR department and I was like, ?Hey guys, I would love to do anything that you have, like I really want to do editorial,? just to let them know. After that, my manager told me that I was ?overly ambitious.' It was pretty mean. So, I just did it all on my own.?

Natural Woman
?The most important thing to me is that the color is flattering ? even if it?s a crazy, kind-of-punky look. I want it to look luxurious and expensive and beautiful. [What] I like to do is emulate natural hair color, so if I'm doing a rainbow-colored hair, I'll keep the root area darker and the hairline and ends lighter. The whole thought is to emulate nature and real hair color (even if it's not!). I get inspired by sunsets and flowers (I know that's super dorky). I once did hair pieces where I copied the inside of a tulip ? peach on the outside, but florescent yellow and hot pink inside. I have an idea for an editorial inspired by birds of prey. They have these unbelievable black-and-white patterns on their wings. It?s so incredible the way these ?unnatural? colors and patterns actually do exist in nature.?

?When I originally started my Tumblr and my Instagram, it [was] for inspiration and to share my work. I was always that kid on show-and-tell day that would raise their hand every week and be like, ?I have something! I have something!? I didn't care what it was; all I wanted to do was get up in front of class and share. Maybe that?s corny, but I just love sharing. Now, though, it actually really helps my business. I have so many clients that come to me because of Instagram or Tumblr.?

Color Shift
?The most exciting thing about color today is how accepted it is. This past Fashion Week, I colored Elaine Welteroth?s [beauty and health director, Teen Vogue] hair green. That never would have flown five years ago. I even have a client that works in finance, and we've been slowly coloring the tips of her hair blood red. If you do it tastefully, and dress and carry yourself in a certain manner, colors like that can fly almost anywhere these days.?

NFL Hall of Fame Inductions and Family Fest Open Thread

Tonight, the Hall of Fame Class of 2013 is enshrined into the Hall. And running alongside that is Family Fest, the Bears' night practice at Soldier Field. Enjoy the dual-purpose Open Thread.

The Hall of Fame is having its induction ceremony tonight over on NFL Network. Back in February the Class of 2013 was announced, and in case you missed it then, the class includes WR Cris Carter, G/T Larry Allen, DT Curley Culp, DT Warren Sapp, coach Bill Parcells, OT Jonathan Ogden, and LB Dave Robinson. As a younger member, as I think I mentioned before, it's pretty jarring to see players you actually watched start to make their way into the Hall. But I digress.

In other news closer to our own hearts, the Bears are holding Family Fest tonight over at Soldier Field. And just think, starting next Friday, it's Hawaiian Shirt Day the first Bears' preseason game. Good stuff.

The host Conception Bay North team handily won both of its round-robin games Friday at the bantam AA provincial baseball championships being staged in Upper Island Cove and Harbour Grace.

CBN opened the tourney with a convincing 16-4 win over Conception Bay South in the opening game of the seven-team event on Friday morning.

The club followed that up with another blowout over Gander, winning by a margin of 13-3.

The team is comprised of players born between 1998 and 1999, and is coached by David Coombs.

The playoff round begins today at 4 p.m., while the championship game is scheduled for 4:30 p.m. Sunday in Upper Island Cove.

Bay Area commuters brace for another BART strike

OAKLAND, Calif. (AP) ? Agencies are planning ways to get San Francisco Bay area commuters to work Monday if there's a transit strike, but officials say no matter what steps are taken there's no way to make up for the idling of one of the nation's largest transit systems

More ferries and buses will be put into operation to get people across San Francisco Bay. Carpool lanes will be open all day Monday, not just for rush hour. And gift cards for coffee will be handed out to drivers who pick up riders.

BART carries more than 400,000 commuters a day, keeping them off the roads in a region routinely choked with traffic.

"The inescapable fact is BART's capacity can't be absorbed by the other transit agencies," said John Goodwin, spokesman for the Metropolitan Transportation Commission. "We're still hoping for the best, but it's time to prepare for the worst."

Meanwhile, Bay Area Rapid Transit and its union were holding weekend-long labor talks in hopes of reaching an agreement by a midnight Sunday.

The two sides were scheduled to return to the negotiating table at 10 a.m. Saturday after recessing for the night Friday.

Key sticking points in the labor talks focused on worker safety, pensions and health care costs, commuters are bracing for what could be the second BART strike in a month.

When transit workers shut down train service for four days in early July, roadways were jammed and commuters faced long lines for buses and ferries. The unions agreed to call off that strike and extend their contracts until Sunday while negotiations continued.

"I didn't really fully appreciate the magnitude of disruption of my commute," said Oakland resident Benny Martin.

Martin, 32, said the short trip to his law firm in downtown San Francisco took him two hours each way. If BART workers strike next week, he just won't go into the office. "It's just not worth it for me."

A strike next week could cause more traffic mayhem than last month's work stoppage, which came around the Fourth of July holiday.

"Without having a holiday in the middle of the week, there's a potential for much greater congestion on the roadways," Goodwin said.

At a news conference Friday, Bay Area and state officials called on BART managers and union leaders to reach an agreement, saying a strike would create financial hardship for working families and hurt the Bay Area economy.

"We need an agreement and not a strike in our BART Service," San Francisco Mayor Ed Lee said. "They need to know that it is no longer a matter of inconvenience to the ridership. It is hardship."

On Thursday, two transit unions? which represent nearly 2,400 train operators, station agents, mechanics, maintenance workers and professional staff ? issued a 72-hour strike notice. They plan to participate in labor talks up until the contract expires at midnight Sunday in hopes of averting a strike.

At a meeting of BART's board Friday, union leaders urged the directors to give workers what they called a fair contract.

"I'm here to say we will not be busted," John Arantes, president of SEIU local 1021. "We are more united now than ever before."

BART General Manager Grace Crunican said the two sides were working hard at the bargaining table, but they remain far apart on wages, pensions and health care. There's still time to reach a deal before the strike deadline, she said.

"Three days is a long time when you've come as far as we have," Crunican told reporters.

Under state law, Gov. Jerry Brown has the authority to seek a court-ordered 60-day "cooling off period" that would temporarily block BART workers from striking.

"The governor is considering all his options and closely monitoring the situation," said spokesman Evan Westrup.

A look at Penn State coach Bill O'Brien's day at ESPN: photos and video

Penn State football coach Bill O'Brien made his rounds through ESPN's most popular radio and television shows yesterday in a series ESPN has called a "car wash" on its Bristol campus.

O'Brien was joined by fellow Big Ten coaches Kirk Ferentz, Mark Dantonio, Brady Hoke and Pat Fitzgerald for a full day of interviews. Among the popular series O'Brien visited were College Football Live, First Take and Recruiting Nation.

O'Brien made 12 stops in all, talking about the usual topics: the sanctions, his remarkable 2012 season, Penn State's sometimes-uphill recruiting battle and his team's prospects in 2013.

Penn State followed O'Brien everywhere he went, including happenstance meetings with NFL reporter Chris Mortensen and baseball analyst Tim Kurkjian. PSU athletics shared the following video and photos. Images from ESPN are in the slideshow with this entry.

Vinterberg orchestrates the material impressively, increasing tension little by little until it becomes overwhelming.

The Hunt offers a powerful, provocative study of mob mentality and the fabric of trust.

Danish actor Mads Mikkelsen delivers an astonishingly restrained and expressive central performance in The Hunt, an engrossing psycho-social drama by Thomas Vinterberg.

An intense, hard to watch drama, of a man's life torn apart by his fellow citizens. The performance is skilled enough that it won the top acting award at last year's Cannesfestival.

Mikkelsen's performance is what makes a good movie even better.

[A] harrowing but flawed study of an innocent man accused of pedophilia.

The film clearly wants us to be uncomfortable about many things; it's not a stretch to imagine that the implications of the premise are among them.

The Hunt is far scarier than the most frightening zombie film.

Shows that even when Klara's parents and their friends aren't sure, they'd rather be wrong on the defensive than be wrong and do nothing.

Actor Mads Mikkelsen excels in this tense drama.

The cornerstone to The Hunt is the mesmerizing performance by Mikkelsen, whose portrayal of a Danish everyman's shattered descent into a horrifying nightmare is one of the most powerful performances I've seen in recent memory.

Mikkelsen makes you empathize with Lucas every step of the way and helps make The Hunt a real moral nail-biter.

It's a powerful and thought-provoking movie.

Mikkelsen is one of Europe's most respected actors, yet he's best known in the United States for playing evil characters... So it's interesting -- and rewarding -- to see what Mikkelsen can do as an innocent, well-meaning leading man.

"The Hunt" is a fantastic showcase for Mikkelsen, who shows he can play a cannibalistic serial killer on TV and a persecuted kindergarten teacher in the movies, and be just as believable as both.

The Hunt will have you balling up a fist and shedding a few tears as the tale unfolds, providing an exquisitely unpleasant conflict that's simply riveting to study.

Fittingly for a film that deals with actions that can't be undone, The Hunt leaves you with a sickening feeling that's almost impossible to shake.

Although the scenario is exaggerated for dramatic effect and it stumbles somewhat in the final act, the unsettling film is a provocative and timely examination of persecution and the perils of public perception.

An uncommonly thoughtful, and thought-provoking, entry in the social-issue drama subgenre, anchored by Mikkelsen's gripping performance.

A subtle piece of moral drama crowned by a truly beautiful performance from Mikkelsen, The Hunt puts every one of us in the crosshairs.

Child molestation is indeed horrific. Sometimes, the response to same can be equally disconcerting. The Hunt argues that all too well.
